CRAIG K – TERMS & CONDITIONS

These Terms and Conditions govern the services provided by Craig K, covering both the DJ Business Services (Section A) and Voice Over/Sweeper Production Services (Section B).

A. DJ BUSINESS SERVICES

1. PAYMENT

1.1. The Booking is not confirmed until the event has been discussed, quoted, and agreed to by Craig K and the Deposit has been paid. The Deposit is NOT refundable. 1.2. The Deposit is to be paid via Bank Transfer (details on invoice) or by cash; the remaining and final payment must be paid in full no later than 7 days prior to your Event Date or on the Event Date itself. 1.3. The Client will be invoiced for the Performance Fee as agreed with Craig K. The Client shall settle the 50% deposit invoice within 14 days of issue, unless otherwise agreed in writing. 1.4. Late Payment: If the outstanding balance is not paid by the due date specified in Clause 1.2, Craig K reserves the right to charge a late payment fee of 5% per day on the outstanding balance, or to treat the booking as canceled by The Client, resulting in the penalties outlined in Section 3.

2. VARIATIONS

2.1. Any variation to the original Booking must be agreed via written communication (email/Messenger etc.). 2.2. Any changes to the agreed Performance will be subject to these Terms and Conditions. 2.3. In the event that Craig K is unable to complete the full performance duration due to a delay in the start of the performance schedule, where such delay is no fault of his, The Client shall remain liable to pay the full Performance Fee. 2.4. Craig K is not obligated to extend any performance (further than the Finish Time) that has started late due to the Client’s or Venue’s actions. 2.5. Should Craig K be requested by The Client to extend the length of the performance past the agreed Finish Time, an additional fee will be discussed and charged, this must be paid in cash before the extension commences. Further rates will be paid at £50 an hour. 2.6. Shall The Client wish to make further bookings or regular bookings, these terms will be adopted by any consequential bookings confirmed in writing, unless new terms are agreed also in writing.

3. CANCELLATIONS

In the event that The Client cancels an Event they will be liable to pay cancellation charges as follows: i) Craig K will retain the agreed Deposit if cancellation is made more than 30 days before the Event Date. ii) Cancellation made within 29 – 15 days of the Event Date: 75% of Total Fee (Deposit + 25% of remaining fee) iii) Cancellation made within 14 days of the Event Date: 100% of Total Fee

3.1. COVID-19: All paid deposits payments will be retained by Craig K in the light of a cancellation regarding COVID-19 (CoronaVirus) by Venue or by Client in accordance with Section 3i, the option of rescheduling future Event Date with Craig K will also be given with no extra deposit cost.

4. VENUE

4.1. If the Venue provided by The Client is unable to accommodate Craig K for any reason and he is unable to perform, for this reason, The Client will be liable for cancellation charges as outlined in Section 3. 4.2. Craig K is obliged to follow any rules and restrictions put in place by the Venue; such as sound limiters and music cut off times.

5. BEHAVIOUR

5.1. The Client agrees that if Craig K is threatened or abused verbally or physically by anyone present at the performance then he will be entitled to stop and not perform. All Fees will remain payable by The Client. It is the responsibility of The Client to resolve the issue. 5.2. The Client is liable for any damages to Craig K equipment as a result of actions by The Client, The Client’s guests (invited or not), or Venue employees. Further reading is outlined in Section 9. 5.3. The Client is obligated to pay for any repairs or replacements as a result of damages. It is then The Client’s responsibility to organise and seek reimbursement from the person(s) responsible, shall they wish to do so. 5.4. The Client agrees to provide adequate supervision of guests and will ensure that venue management adequately supervises customers and or staff on site premises. Craig K will not be liable for the supervision of minors.

6. UNFORSEEN CIRCUMSTANCES

In the event of unforeseen circumstances preventing Craig K attendance at the event. He will: i) Inform The Client as soon as reasonably practicable. ii) Use reasonable endeavours to arrange a mutually agreeable substitute for the event, for which The Client will be responsible for payment of the replacement act. iii) If he is ill and unable to attend, a full Deposit refund will be issued.

7. FORCE MAJEURE

Craig K will not be liable for failing to attend a booking, where the reason for non-attendance or late arrival is caused by: adverse weather conditions (including Snow & Flooding), road closure, road traffic accident, vehicle breakdown, acts of terrorism, industrial action, or other unavoidable circumstances deemed beyond his control. Craig K will not be held responsible for any consequential loss whatsoever.

8. PUBLIC LIABILITY INSURANCE

8.1. Craig K is fully insured with Public Liability Insurance from the MOBILE DJ NETWORK and is insured up to £10,000,000.

9. EQUIPMENT AND MUSIC

9.1. It is agreed by the Client that the equipment and instruments of Craig K are not available for use by other performers or persons except by specific permission of Craig K concerned. 9.2. It is agreed by the Client that NO Third Party equipment will be connected to any of Craig K equipment at any time during the Event. 9.3. It is agreed that Craig K equipment can NOT be used by the Client, Clients guests or Venue employees or staff for singing/performing their own music or karaoke. Failure to agree with this will result in action under Section 5.1. 9.4. It is agreed that Craig K equipment can NOT be moved or carried in or out of the venue by the Client, Clients guests or Venue employees or staff. Failure to agree with this will result in action under Section 5.1. 9.5. The client will be held responsible for any theft or damage of any equipment (including vehicles stored on the premises) belonging to Craig K caused by anyone other than members of Craig K. 9.6. It is agreed that Craig K is happy to take music requests from The Client and Clients Guests, but holds the right to use professional judgement to refuse the playing of a track if it is deemed not appropriate, offensive, racist or not suited to the clientele during the Event. Failure to agree to this will result in action under Section 5.1.

B. VOICE OVER/SWEEPER PRODUCTION SERVICES

1. Order Confirmation & Acceptance

1.1 By placing an order, the Client confirms they have read and agree to these Terms & Conditions.
1.2 Orders are confirmed upon agreement of scope and/or payment unless otherwise agreed in writing.


2. Delivery

2.1 Audio files will be delivered via email or file-sharing service (e.g. WeTransfer).
2.2 Standard turnaround is approximately 24 hours but is not guaranteed.
2.3 Where delays occur, Craig K will notify the Client and provide a revised timeframe.


3. File Specifications

3.1 Standard delivery format is MP3 (192kbps).
3.2 WAV format must be requested prior to recording.


4. Revisions

4.1 Each project includes one (1) revision unless otherwise agreed.

4.2 The included revision covers:

  • Minor script adjustments
  • Tone, pacing, and emphasis changes
  • Minor mix adjustments

4.3 Additional revisions may be chargeable.

4.4 The following are not included and may incur fees:

  • Script rewrites or major changes
  • Style/performance changes after approval
  • Re-records due to incorrect client information

4.5 Errors made by Craig K (e.g. mispronunciations) will be corrected free of charge.


5. Revision Process 

5.1 The Client must provide clear and actionable feedback.
5.2 If revisions are declined, or not pursued, the project will be deemed complete and accepted.


6. Acceptance & Usage

6.1 The Client is responsible for reviewing all audio upon delivery.
6.2 Any use of the audio (including broadcast or upload) constitutes full acceptance of the work.


7. Creative Nature of Work

7.1 Voice over and audio production is a subjective, creative service.
7.2 Differences in tone, style, or interpretation do not constitute failure where reasonable care and skill have been exercised.


8. Client Responsibility

8.1 The Client must ensure all scripts and instructions are accurate and final before recording.


9. Refunds

9.1 Due to the bespoke nature of the service, no refunds are offered once work has been delivered.
9.2 The revision process is the sole remedy for concerns.
9.3 Refunds will not be provided where:

  • Revisions are declined
  • The work has been used
  • The issue relates to subjective preference

10. Content Liability

10.1 The Client confirms they hold all necessary rights for supplied content.
10.2 The Client indemnifies Craig K against any claims arising from its use.


11. Usage Rights (Licensing)

11.1 The Client is granted a non-exclusive licence for agreed use.
11.2 Audio may not be resold or redistributed without permission.
11.3 Craig K retains the right to reuse voice performances unless exclusivity is agreed.


12. Jurisdiction

12.1 These terms are governed by the laws of England & Wales.
